Guest Column: Not Executive Order — it’s ‘administrative fiat’

The result is the same. Friday, June 17, the Barack Obama (D) administration issued a memo announcing federal immigration officials do not have to deport illegal aliens if they are enrolled in any type of education program, if their family members have volunteered for U.S. military service, if they are nursing or if they are pregnant.

This new policy of “prosecutorial discretion” was announced quietly, and completely ignored by the mainstream press. Since the DREAM Act (Development, Relief and Education for Alien Minors) failed in Congress, its provisions have now been effectively imposed on the American people against their will.

Immigration and Customs Enforcement (ICE) agents have been speaking out on the “backdoor amnesty.” According to ICE union president Chris Crane, representing about 7,000 agents and support staff: “Any American concerned about immigration needs to brace themselves for what’s coming. This is just one of many new ICE policies in queue aimed at stopping the enforcement of U.S. immigration laws in the United States.

“Unable to pass its immigration agenda through legislation, the administration is now implementing it through agency policy,” Crane continued. “ICE and the administration have excluded our union and our agents from the entire process of developing policies. It was all kept secret from us. We found out from the newspapers. ICE worked hand-in-hand with immigrants rights groups, but excluded its own officers.

“Our officers are already under orders not to make arrests or even talk to foreign nationals in most cases, unless another agency has already arrested them; you won’t find that written in any public ICE policy,” Crane added.

The Obama regime consists of radical leftists who believe America is the focus of evil in the modern world, and if America is reduced to a non-power, the world will be a better place. Their dream of destroying America has now taken another giant step. This administration has exploded the annual deficit to the level where it can never be repaid, spending the wealth of several generations in the future. It has embraced our enemies and snubbed our allies, insulting and endangering Israel. It has demonstrated staunch support of ACORN and the New Black Panthers, while arrogantly mocking and disrespecting American citizens.

The president has appointed numerous czars who do not answer to Congress. He has defied the courts, blocking off-shore oil drilling, while subsidizing Brazil to drill nearby.

Also ignored by the press was last year’s no-confidence vote ICE agents gave Obama appointee, ICE director John Morton. Now, we are just told to “brace ourselves.” With absolutely no disincentive to sneak over the border, millions more illegals are now expected. The rule of law has collapsed in Mexico, and that anarchy is already moving north.

However, Border Patrol interdiction teams are being told not to enforce the law on the border. They are ordered to face well-armed drug smugglers using “bean bag guns” first! Some agents have been killed, and some have actually been indicted for just doing their jobs.

In 2010, more than 212,000 illegal aliens were taken into custody attempting entry into the United States through Arizona’s Tucson sector. Between 15-23 million foreign nationals reside illegally in the United States today.

Indiana’s new E-verify law was challenged by the American Civil Liberties Union, and the U.S. Supreme Court upheld the constitutionality of E-verify for those employers who are willing to use it, but DOES NOT MANDATE its use. Alabama and Georgia have similar new laws.

In Congress, House Judiciary Committee Chairman Lamar Smith has introduced H.R. 2164, the Legal Workforce Act, which would make E-Verify mandatory and permanent after a three-year phase-in period. Meanwhile, Democrats continue to push the open-borders-plus-amnesty agenda. U.S. Sen. Bob Menendez (D-N.J.), U.S. Sen. Dick Durbin (D-Ill.) and U.S. Sen. Patrick Leahy (D-Vt.) held a Capitol Hill press conference to present a measure similar to the one defeated in 2007.

In Illinois, State Rep. Randy Ramey (R-DuPage County) is chief sponsor of H.B. 1969. Similar to Arizona law, it allows local police to determine immigration status of people lawfully stopped or detained. But since the Illinois DREAM Act passed, and redistricting is sure to quash many pro-Minutemen Republicans, we are extremely pessimistic here in northern Illinois about any improvement on the state level. There should be a U.S. Attorney, and a coalition of county sheriffs and state’s attorneys, to challenge Illinois Gov. Pat Quinn’s (D) statement that Illinois would cease to participate in the American Secure Communities Program. U.S. Homeland Security Secretary Janet Napolitano has stated the program is mandatory, NOT OPTIONAL. It has been very effective in the Rockford area … but has been discontinued by Winnebago County Sheriff Richard Meyers. See the web page
