$1 million free speech lawsuit heads toward trial in federal court
The $1 million lawsuit against Winnebago County and 13 individuals just survived a “Request to Dismiss” submitted by State’s Attorney defense lawyer William Emmert.
The federal lawsuit (Case 11 C 50046), filed by a local citizen, Michael Castronovo, is now in the “Discovery Stage” with evidence being compiled that includes documents, testimony, and audio and video recordings.
Depositions of defendants are slated to start later in November, beginning with defendants Pearl Hawks, Wayne Vlk and Scott Christiansen.
The actual trial date has not been set, but it is expected to be scheduled for late spring or early summer 2012.
In an unusual turn of events, the plaintiff (Mike Castronovo) and one of the defendants (Scott Christiansen) will also be running against one another for the office of Winnebago County Board Chairman in the March 20 primary.
