Local attorney lands largest reported product liability settlement in Ogle County history

Rockford attorney Thomas Fabiano, of Fabiano Law Offices, has won a $1.5 million lawsuit for his client, Christy Batsch of Ogle County, against the Rockford Gander Mountain store for selling a defective climbing tree stand product. This is the highest reported product liability settlement in Ogle County history.
Oct. 24, 2004, in the rural fields of Ogle County, Batsch, then 29 years old, was hunting deer while in a tree stand approximately 15 feet from the ground. Batsch reached that vantage point by using a climbing tree stand purchased from the Rockford Gander Mountain store.
While Batsch was in the climbing tree stand, the safety lock for the tree stand opened up, causing Batsch to fall to the ground. Fabiano argued that for 59 cents — the cost of a safety pin — the tragedy would have been avoided.
Batsch was flown by a medical helicopter to the University of Wisconsin Hospital in Madison, Wis., for treatment of her injuries. As a result, Batsch suffered a fracture to her ankle that led to her leg being amputated below the knee.
The case is identified as Christy Batsch v. Gander Mountain, 06 L 33, Ogle County, IL.
Fabiano has been practicing law for 20 years, the last 16 years as a partner in Fabiano Law Offices concentrating his practice on representing people who have suffered serious personal injuries as the result of another’s negligence or wrongful conduct.
