First Winnebago County residence seized under gang nuisance abatement statute at 180 15th Ave.

In early March 2012, members of the Rockford Police Department identified ongoing gang violence associated with the residence at 180 15th Ave. The gang violence included incidents that occurred at 180 15th Ave. and incidents involving the residents of 180 15th Ave.
The information was reviewed with the Winnebago County State’s Attorney’s Office. April 24, the Winnebago County State’s Attorney Office presented a preliminary injunction under the gang nuisance abatement statute before Winnebago County Circuit Judge J. Edward Prochaska.
At the conclusion of the court proceeding, Judge Prochaska issued the preliminary injunction for the residents of 180 15th Ave. to vacate the property within a seven-day period.
The preliminary injunction will remain in effect for a 30-day period. The preliminary injunction restrains all people from being present, occupying or using the residence.
May 1, at approximately noon, members of the Rockford Police Department executed the preliminary injunction at 180 15th Ave. Upon their arrival to the residence, the residence was inspected by the City of Rockford Building Department. The residence was condemned by the Building Department for health and safety violations.
Rockford Mayor Larry Morrissey (I) said: “I am very pleased that State’s Attorney [Joe] Bruscato has taken measures to stop the gang violence at this property. This is a great example of how our Rockford Police Department can partner with the State’s Attorney to protect our community. We will continue to partner wherever we can to eliminate gang violence from our community.”
Rockford Police Chief Chet Epperson added: “Collaborative efforts by the Rockford Police Department and Winnebago County State’s Attorney’s Office were instrumental in closing down a problem residence associated with gang violence in Rockford. The closing of the residence on 15th Avenue will improve the quality of life for the residents that live in that area of the city.”
This is the first time a residence has been seized under the gang nuisance abatement statute in Winnebago County.
