Man sentenced to a total of six years for battery of a peace officer, threatening a public official

Thomas Vojtech, 31, pled guilty July 6 to the charges of aggravated battery to a peace officer and threatening a public official. The defendant was sentenced by Judge Rosemary Collins to four years in the Illinois Department of Corrections for the offense of aggravated battery to a peace officer and two years in the Illinois Department of Corrections for the offense of threatening a public official.
On the evening of June, 18, 2011, a Winnebago County Sheriff’s deputy was dispatched to Machesney Park in response to a neighborhood trouble call. A witness advised the deputy that the defendant was yelling and cursing at neighbors. The witness reported that the defendant jumped the fence and kicked the neighbor’s dog and then got into his vehicle.
The deputy approached the vehicle and identified himself as a police officer. The deputy ordered the defendant not to leave the scene. The deputy placed his hand on the defendant’s arm while he was still in the vehicle. However, the defendant put his foot on the gas pedal and accelerated. The deputy’s arm caught between the door frame and the driver’s-side door, with his upper arm striking the door frame as the car moved forward into it. The deputy was able to free his arm prior to sustaining any serious injuries.
The defendant fled the scene and was later taken into custody by Byron police officers. The defendant posted bond on the aggravated battery charge and was released from custody.
May 5, 2012, Winnebago County Sheriff’s deputies were again dispatched regarding domestic trouble involving the defendant. The residence belonged to the defendant’s ex-girlfriend who informed deputies that she told the defendant to leave; however, he refused and threatened to kick in the door.
The ex-girlfriend indicated the defendant repeatedly beat on her door and that his behavior was scaring her.
As deputies attempted to take the defendant into custody, he struggled before they were able to get him handcuffed and transported for booking. The defendant was uncooperative and confrontational through the entire booking process, and had to be physically restrained. When he was being restrained, the defendant threatened to harm the deputy after the defendant was released from custody.
Aggravated battery to a peace officer is a class 2 felony with a sentencing range of three to seven years in the Illinois Department of Corrections or probation. Threatening a public official is a class 3 felony with a sentencing range of two to five years in the Illinois Department of Corrections.
